Construction/Design Professionals
The firm offers exceptional and experienced attorneys to clients involved in disputes or ongoing litigation arising from construction projects, large and small. Throughout the years, Montgomery Little & Soran has represented nearly all participants in the building and construction industry, including owners, developers, engineers, architects, contractors and subcontractors. Representing clients in arbitration proceedings and mediation conferences, as well as in litigation in various state and federal courts, is all a part of the firm’s construction law practice.
Our attorneys have both prosecuted and defended claims associated with a variety of construction projects, including large commercial office buildings, shopping centers, schools, public works, hotels, condominium projects, apartment complexes and residences. Construction law practice requires not only a working knowledge of industry standards and government regulations, but also an understanding of the construction process and the role of the various participants; the firm has carefully cultivated knowledge and expertise.
In recent years, many construction projects have encountered environmental problems, including toxic waste contamination. Partly because of the firm’s representation of companies involved in claims concerning soil and water contamination by petroleum products, our attorneys have acquired extensive knowledge and experience in a broad range of litigation claims involving contaminated soils and water. The nature of the soil in this region, and specifically the ubiquitous presence of expansive soils, along with the current building boom, seem to provide a never-ending array of claims arising from soil issues. Montgomery Little & Soran offers established experience and skill in the litigation of these claims. The firm also has extensive experience in mechanic's lien litigation and fee collection issues.
Given the firm's broad experience, which includes expertise in the fields of construction law, soil expansion, soil contamination and architect/engineer professional liability, Montgomery Little & Soran is able to offer advice and legal counsel to clients seeking to prevent or mitigate problems in these areas through effective contract negotiation, pre-litigation representation, and, when necessary, representation in arbitration, litigation and dispute resolution. We also are pleased to provide legal counsel on the front end of projects by offering our services in contract negotiations and formation.
The firm proudly offers the services of three of its seasoned litigators and partners, David C. Little, William H. Knapp and Frederick B. Skillern, as arbitrators and mediators in construction disputes.
